Terms of Use for the Community Portal of Infosim GmbH & Co. KG

1. Scope of Application

These Terms of Use govern the use of the Community Portal (hereinafter “Portal”) of Infosim GmbH & Co. KG (hereinafter “Operator”). By registering and using the Portal, the user agrees to these Terms and conditions.

2. Registration and User Account

Use of the Portal requires registration. The user is obliged to provide truthful and complete information. Access to the Portal is personal and may not be disclosed on to third parties. The user is responsible for the security of his password.

3. Use of the Portal

The Portal is used for the exchange of information and the downloading of documents and materials provided. The user is obliged not to impair the technical infrastructure of the Portal.

4. Intellectual Property

All content made available on the Portal is protected by copyright. It may be used for personal and – with the explicit consent of the operator – also for commercial purposes, provided that it is used in the original form as made available on the Portal and not modified in any way.

5. Data Protection

The operator processes the user’s personal data in accordance with the applicable data protection laws.
The Operator’s privacy policy, available at https://www.infosim.net/privacy/, is an integral part of these Terms.
User behavior is recorded and can be evaluated for the purposes of quality assurance and abuse control.
The following data is stored and processed:

User’s name and email address
Login timestamp
Page views
File downloads
Form submissions

The user has the right to information, correction or deletion of his data at any time in accordance with the statutory provisions.

6. Termination of Use

The user can quit the Portal at any time and have their user account deleted. An informal email to accountrequest@infosim.net is sufficient for this purpose.
The operator reserves the right to block or delete user accounts in the event of violations of these Terms. Furthermore, the operator reserves the right to delete user accounts that have been inactive for a period of 12 months or more. In such cases, users will be notified in advance via email.

7. Changes to the Terms of Use

The operator reserves the right to change these Terms at any time. The user will be informed of these changes and may object to them within a specified period. If the user continues to use the Portal after the changes have come into effect, they shall be deemed to have been accepted.

8. Disclaimer

The operator accepts no liability for the accuracy, completeness or timeliness of the content provided. The operator shall not be liable for damages arising from the use or non-availability of the Portal unless they are based on intent or gross negligence.

9. Applicable law and place of jurisdiction

The law of the Federal Republic of Germany shall apply. The place of jurisdiction is Würzburg.
